MOMENTUS ACADEMY THE ACTORS BREAKTHROUGH WORKSHOP TERMS & CONDITIONS
PARTICIPATION AGREEMENT AND RELEASE OF LIABILITY
PLEASE READ THIS PARTICIPATION AGREEMENT FORM CAREFULLY. IT IS A BINDING AGREEMENT, CONTAINING PROVISIONS
RELATING TO IMAGE USE, RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION AND MEDICAL
EMERGENCY PERMISSION. IT AFFECTS THE RIGHTS YOU MAY HAVE IF YOU OR YOUR CHILD IS INJURED OR OTHERWISE SUFFERS DAMAGES
WHILE PARTICIPATING IN MOMENTUS ACADEMY AND THE ACTORS BREAKTHROUGH WORKSHOP.
This Participation Agreement and Release of Liability Agreement (“Agreement”) is entered into on the date of the event and Momentus Workshop by and among all participating, on the following terms and conditions:
Momentus Workshop: Participants will participate in the Momentus Workshop (“Momentus Workshop”) scheduled to take place on the date acknowledged and paid for by reserving a spot/seat for the Momentus Workshop day.
Momentus Academy is a place of education, not an acting or modeling agency and makes no representation or warranty with regard to participants potential for success in the acting or modeling industry or as to whether the training offered by Momentus will lead to opportunities for participants. Momentus has no obligation to introduce Participant to management companies/agencies, publications, brands or photographers, other than those introductions that may take place at Momentus during the Momentus Workshop session. Momentus Academy has no affiliation with any other business venture, including without limitation, Jamie Freed Mgmt.
DEPOSITS/FEES:
In consideration of the foregoing, participant agrees to pay Momentus the following fee for each Momentus Workshop attended (“Momentus Workshop Fees”) payable as set forth below:

Momentus Workshop fees are non-refundable. Momentus Workshops cannot be postponed. In the event COVID-19 or a similar pandemic is an issue during the time of your Momentus Workshop, stopping travel or businesses from operating, we will work with you to reschedule you for a future date. The full Momentus Workshop Fee must be paid upon sign up. No participant may enter the Momentus Workshop without making a full payment. All payments can be made via these means:

RISKS/INSURANCE/EMERGENCY CONTACTS:
Participant hereby acknowledges and accepts that participation in the Activities and residence at Momentus may possibly expose Participant to known and unknown risks. Participants confirm that to the best of their ability they will keep a minimum 6 feet of distance from all participants and staff at Momentus for the duration of the Momentus Workshop. Participants will not invite other participants. Participants acknowledge that an inherent risk of exposure to COVID-19 exists in any public space world-wide where people are present. By attending Momentus Academy and Workshop, Participants assume all risks related to exposure to COVID-19 and agree not to hold Momentus or Jamie Freed; or any of their affiliates, employees, contractors or volunteers liable for any illness or injury. Participant hereby represents and warrants that Participant is of sufficient physical and mental health to participate in the Activities and to participate at Momentus Academy and Momentus Workshop and participant has no physical or mental condition that could affect participants ability to participate in the Activities and to reside at Momentus and the Momentus Workshop. Participant hereby grants to the Momentus Workshop and its representatives, full authority to take whatever actions they may deem appropriate and warranted under any circumstances regarding the protection of Participants health and safety. Participants understand that if Participants requires medical treatment while attending Momentus and Momentus Workshop, an attempt will be made to contact the Emergency Contacts Participant provided. In the event such Contact cannot be reached, Participant hereby consents to such treatment. Participant confirms that Participant has medical insurance coverage appropriate for Participants participation in the Activities.
MOMENTUS WORKSHOP RULES
The address of the Momentus Workshop may not be disclosed to the public. Participant acknowledges that Participant is expected to be courteous and respectful to fellow Participants and to Momentus Workshop staff. Participants will not keep or consume illegal drugs on Momentus Workshop premises. Participants will not smoke indoors on Momentus Workshop premises. No guests will be permitted to visit. Each Participant is responsible for her own personal belongings while at Momentus Workshop and Participant understands that all items brought to Momentus Workshop should be clearly marked with the Participant's name. Momentus Workshop assumes no responsibility for any personal items brought to Momentus Workshop. Participant hereby acknowledges and agrees that the information, strategies and techniques shared by Momentus Workshop with Participant are commercially valuable, proprietary, and confidential information and trade secrets (“Confidential Information”) of the Momentus Workshop. In consideration of Participant having access to Confidential Information, Participant agrees that Participant will use Confidential Information solely in connection with Participant’s own acting or modeling career, will not disclose or share Confidential Information with any third party and will not use Confidential Information in connection with any commercial purpose or enterprise whatsoever, including, without limitation, in connection with a acting or modeling school or Momentus Workshop. In addition, Momentus Workshop will be entitled to seek all available means of legal redress for Participant’s breach of any provision of this Agreement, including, without limitation, injunctive relief without the need to post a bond.
In the event Participant violates any of the provisions of this Agreement, or at any time acts in a manner that, in Momentus Workshop’s sole opinion, may be detrimental to other Participants, to Momentus Workshop staff or to the professional reputation of the Momentus Workshop, Participant will be asked to immediately leave Momentus Workshop premises. Such request will not subject Momentus Workshop to any liability whatsoever or require Momentus Workshop to return the Session Fees or any portion thereof. Participant Parent and Participant understand that Mr Freed or other members of the staff may from time to time take photographs or video/audio recordings during the Session that Momentus Workshop may use on its website or social media. Participant understands that any photographs or video/audio recordings taken by Participant during Participant’s stay at Momentus Workshop may be used solely in connection with Participant’s personal social media accounts, and for no commercial purpose whatsoever. No geotags are permitted.
INDEMNITY
In consideration of Participant being permitted to participate in Momentus Workshop and its related events and Activities, the
undersigned acknowledges that as the parent an/or legally authorized guardian if not of legal age, do hereby for myself, my spouse, my child and on behalf of my/our heirs, personal representatives and assigns, hereby covenants not to sue, and agrees to indemnify, defend and hold harmless Momentus Workshop and its directors, officers, employees, contractors, agents and representatives (collectively, the “Released Parties”) from and against all losses, liabilities, claims, damages, penalties, fines, judgments, awards, settlements, of whatever nature, at law or in equity, for any and all known or unknown, foreseen or unforeseen, bodily or personal injuries, death, illnesses, damage to property or other losses, and any consequences thereof, including, costs, fees, attorneys’ fees and expenses (collectively, the “Losses”) that may be sustained by Participant, that directly or indirectly, arise from, relate to or result from Participant’s participation in any Momentus Workshop Activity or residence at Momentus Workshop.
MISCELLANEOUS
This Agreement constitutes the entire agreement between the parties and will be governed by the laws of the
state of California without effect being given to its conflicts of law provisions. The parties hereto hereby
consent to the venue and jurisdiction of the state and federal courts located in California. In the
event any provision of this Agreement is held unenforceable, all other provisions of the Agreement will
continue in force and effect.
I have read and fully understand this Agreement and that it is legally binding and enforceable.
